Policies, Etiquette and Safety Guidelines

General Policies
- Members and guests must observe the Fitness Centre policies and etiquette at all times.
- Outdoor footwear and food is not permitted in the Fitness Centre.
- Please avoid wearing perfume or scents in the Fitness Centre.
- If you would like to listen to audio of your own choice please use headphones or earbuds as personal speakers are not permitted.
- The Fitness Centre is not responsible for loss, theft or damage to personal property. Please store your personal property in a day locker during your visit. Locks are available for purchase at the desk.
- Outside trainers and/or coaches are not permitted to train clients in our facility.
Instructions from staff must be adhered to at all times.
- Management reserves the right to refuse entry, suspend or cancel membership if rules and policies are not followed. A verbal and/or written warning will be given first. Failure to comply will result in suspension or cancellation of facility access and/or membership without refund.
- Management and staff reserves the right to refuse entry to any person at any time or to remove persons guilty of disruptive or disorderly conduct including, but not limited to; verbally or physically threatening staff or other persons, swearing aloud, dangerous and/or disruptive behaviour and gaining unauthorized and/or wrongful access.

Change Rooms
-Please remove your outdoor shoes before entering the change rooms.
- Please bring a lock to secure your personal items in the available day lockers. Bags are not permitted on the Fitness Centre floor. Locks are available for purchase if needed. The Sport Manitoba Fitness Centre has the right to remove any locks left on lockers overnight. Please see Member Services to inquire about monthly locker rental.
- Please wipe down your locker before and after use.
Mobile phone use is prohibited while in the change rooms.

On the Floor
- Always wipe down and clean equipment before and after each use.
- Be respectful of others and keep the space organized and clean. Please return and sanitize all free weights and equipment to storage racks after each use.
- Please do not move larger equipment (ie. bikes, rowers, etc.).

Classes
- Pre-booking is recommended to reserve your spot in class. Please arrive to class 5 minutes prior to start time.
- Please advise your class instructor if you are new, have an injury or medical condition.
- Class cancellation policy Be sure to cancel a minimum of 60 minutes prior to the class start time to avoid forfeiting your class and, when applicable, to allow another member from our waitlist to join.

Refund Policies
- Memberships - There are no refunds, holds, transfers for any memberships. Cancellation for 6 month or 1 year memberships are granted for medical reasons only with required supporting documents emailed to fitness@sportmanitoba.ca. Cancellation for monthly memberships are available at any time with 14 days notice via email to fitness@sportmanitoba.ca.

- Classes and Passes - Class drop-ins and class passes are non-refundable.

Cancellation Policy for Services
- Personal training or wellness services can be cancelled or rescheduled anytime prior to 24 hours of the scheduled session at no additional charge. Cancellation LESS than 24 hours of the scheduled session will be charged in full for that session. Your trainer or coach will utilize that time to work on your program.

Waiver

Waiver and Release
I intend to use some or all of the activities, facilities, programs and services offered by Sport Manitoba Inc. (Sport Manitoba) and the Sport Manitoba Fitness Centre (the "Centre").

In consideration of being allowed such use, I do hereby waive, release and forever discharge Sport Manitoba, any associated or related persons, or any directors, officers, employees, agents, contractors, volunteers, insurers, successors, assigns or sponsors representatives and all others acting on its behalf (the "Releasees") from any and all claims or causes of action (known or unknown) for any and all injury, illness, damage or loss that may occur to me or my property as a result of my participation in any aspect of the activities, facilities, programs and services offered at or by the Centre, including, but not limited to, my use of equipment or machinery in connection with the activities, facilities, programs and services offered at or by the Centre.

I understand that each person (myself included) has a different capacity for participating in activities, facilities, programs and services and that participation carries an inherent risk. I am aware that all activities, facilities, programs and services offered are educational, recreational or self-directed in nature. I agree that my participation is strictly voluntary and has not been requested or required by the Releasees. I further agree that I assume any and all risk of injury, illness, damage or loss that might result. I further agree to assume all risk of damage, loss or theft to or of any of my personal property.

I declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation. I acknowledge that I have either had a physical examination and have been given a physicians permission to participate or that I have decided to participate without the approval of my physician. I assume all responsibility for my participation in the activities, facilities, programs and services offered at or by the Centre and for my utilization of any and all equipment and machinery in connection with these activities, facilities, programs and services.

I understand that the activities, facilities, programs and services offered by the Centre may sometimes be conducted by persons who may not be knowledgeable, licensed, certified or registered instructors or professionals. I accept the fact that the skills and competencies of some Centre employees, agents, representatives or volunteers will vary according to their training and experience and that no claim is made to offer assessment or treatment of any mental or physical disease or condition by those who are not duly licensed, certified or registered and employed to provide such professional services.

I understand that personal trainers and fitness coaches not under contract with Sport Manitoba are strictly prohibited from conducting classes or training with clients within the Sport Manitoba Fitness Centre. I understand this rule is in place to ensure my safety and that failure to comply may result in being denied access to the Sport Manitoba Fitness Centre.

I hereby grant the right to use or disclose, without payment of any fee, charge, or compensation of any kind, including royalties, any and all photographs, video tape, audio or other visual media (the Images) of myself taken by Sport Manitoba for promotional purposes. I also agree to waive any right to approve such use, and waive all moral rights I have in such Images in perpetuity.

Your name and email address may be used to correspond with you regarding your participation, and to send you information about current and future Sport Manitoba programs and services. Sport Manitoba may also contact you to conduct research in an effort to continually improve programs. Your personal information will not be used for any other purpose without your consent. Sport Manitoba makes its contact information available to the provincial sport organizations when reasonable (to confirm rosters, clinic notification, etc.). Sport Manitoba may also make your contact information available to the Province of Manitoba when reasonable (to send congratulations). You may withdraw your consent to any further collection, use or disclosure of information about you at any time by giving reasonable notice to Sport Manitoba.

Those under 18 years of age must have this form signed by a parent or guardian.
